Aviarai (“Aviarai,” “we,” “us,” or “our”) is committed to protecting your privacy and ensuring the security of your personal and farm data.

This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform, including our website, mobile applications, and related services (the “Platform”).

We process your data for the purpose of providing access to your AVIARAI account, managing your AVIARAI account, providing farm management, analytics, monitoring, and decision-support services, processing subscription payments, providing customer support, improving platform functionality and user experience, detecting fraud, ensuring platform security, and complying with legal and regulatory obligations.

This Policy is designed to comply with:

• The Nigeria Data Protection Act (NDPA) 2023

• Applicable regulations, directives, and guidance issued by the Nigeria Data Protection Commission (NDPC), including the General Application and Implementation Directive (GAID)

• Aviarai’s obligations as a registered Data Controller/Processor of Major Importance under the NDPC (Registration ID: NDPC/DCP/12426)

• The General Data Protection Regulation (GDPR), where applicable

• Applicable U.S. privacy principles and industry best practices

 2. DEFINITIONS

  • “Personal Data”: Any information that identifies or can identify an individual. 
  • “Processing”: Any operation performed on data (collection, storage, use, etc.). 
  • “Controller”: Aviarai, determining how and why data is processed. 
  • “Processor”: Third parties processing data on our behalf. 
  • “User Data”: Farm and operational data you input into the Platform. 

3. INFORMATION WE COLLECT

3.1 Personal Information

  • Phone number 
  • Account credentials

3.2 Farm and Operational Data (including but not limited to):

  • Feed records 
  • Egg production data 
  • Mortality rates 
  • Environmental conditions 
  • Flock performance metrics 
  • Inventory and input usage data 
  • Any other data you input into the Platform in connection with your farm operations

The categories above are representative and may evolve as the Platform develops.

We do not store full card or bank details. Payments are handled by secure third-party providers.

  • IP address 
  • Device type 
  • Browser type 
  • Usage logs 
  • Cookies and analytics data 

4. LEGAL BASIS FOR PROCESSING AND USE OF DATA

Aviarai acts as:

• a Data Controller for account registration, billing, platform administration, marketing, customer support, and related business operations; and

• a Data Processor for customer farm operational data processed on behalf of users.

We process personal data under the following legal bases:

• Contract Performance – to provide, operate, maintain, and support the Platform and related services.

• Consent – for marketing communications, optional features, and certain product improvement activities where consent is required.

• Legitimate Interests – to improve platform functionality, develop analytics and insights, ensure platform security, prevent fraud, manage subscriptions and payments, communicate service updates and alerts, and enhance user experience.

• Legal Obligation – to comply with applicable laws, regulations, lawful requests, and regulatory requirements.

Where required, Aviarai may enter into Data Processing Agreements (DPAs) with customers and partners governing the processing of customer data.

5. AI AND DATA USAGE TRANSPARENCY

Aviarai uses your data to generate analytics, predictions, and insights.

We may:

  • Analyze your data to improve platform accuracy 
  • Use aggregated, anonymized data for
    • benchmarking and research 
    • Model training 
    • Product development 

We do not:

  • Sell your personal or farm data 
  • Use identifiable data for third-party marketing 

6.DATA SHARING AND DISCLOSURE

We may share your data with:

6.1 Service Providers

  • Cloud hosting providers 
  • Payment processors 
  • Analytics tools 

List of sub-processors available upon request.

All providers are bound by confidentiality and data protection obligations.

6.2 Legal Authorities

Where required by law, regulation, or legal process.

6.3 Business Transfers

In the event of:

  • Merger 
  • Acquisition 
  • Investment 

Your data may be transferred under strict confidentiality.


7. INTERNATIONAL DATA TRANSFERS

Transfers comply with Standard Contractual Clauses (SCCs).

  • For the duration of your subscription 
  • For a 30–90 days after termination 
  • As required for legal, tax, or regulatory purposes 

After this, data is securely deleted or anonymized.


9. DATA SECURITY 

We implement industry-standard safeguards, including:

  • Encryption (in transit and at rest) 
  • Access controls 
  • Firewalls and monitoring systems 

However, no system is 100% secure.

9.1 DATA BREACH

We will notify affected users within 72 hours where required by law.


10. YOUR RIGHTS

You have the right to:

  • Information about the data collected, the purpose of collection, the identity of the data controller and any third parties to whom the data will be disclosed.
  • Access to your personal data and obtain a copy of it, often in a structured, electronic format.
  • Correct inaccurate, outdated or incomplete data.
  • Deletion of your personal data when it is no longer necessary or there is no legitimate reason for the company to retain it.
  • Withdraw Consent
  • Data Portability
  • Object to Processing
  • File Complaints with the Nigeria Data Protection Commission (NDPC) or the European Data Protection Board where applicable.
  • Users may request restriction of processing and lodge complaints with relevant authorities.

  • All decisions remain solely at the discretion of the user, and Aviarai does not independently execute or enforce any operational actions.
  • Users retain full control over decisions.
  • Aviarai does not make legally binding automated decisions.

Aviarai uses trusted sub-processors (e.g., cloud providers, payment processors).


15. POLICY UPDATES

We may update this Privacy Policy from time to time.
